New Hampshire Equine Activity Warning
WARNING: Under New Hampshire law, an equine activity sponsor, equine professional, or other person is not liable for an injury to or death of a participant in equine activities resulting from the inherent risks of equine activities (RSA 508:19).
Assumption of Risk
I, the undersigned, fully understand and acknowledge that horseback riding and related equine activities involve inherent risks, including but not limited to:
- The unpredictable nature, reactions, and behavior of horses.
- Risks of terrain, obstacles, and natural conditions (such as rocks, wildlife, rivers, uneven ground).
- Risks of equipment failure, tack malfunction, or rider error.
- Risks of injury, illness, or accident occurring on or around the premises, barns, trails, or tie-up areas.
I voluntarily assume full responsibility for all risks of injury, death, property damage, or other loss that may result from my participation in horseback riding or related activities at Ryder's Riverside Trails.
Release of Liability
In consideration of being permitted to ride, handle, or be near horses at Ryder's Riverside Trails, I hereby release, waive, discharge, and hold harmless Ryder's Riverside Trails, its owners, employees, volunteers, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death, whether caused by negligence or otherwise.
Rider Responsibilities
- I agree to follow all safety rules and instructions provided by Ryder's Riverside Trails staff.
- I agree to wear appropriate safety gear, including helmets when required.
- I certify that I am physically and mentally capable of safely participating in horseback riding activities.
- I agree not to sue Ryder's Riverside Trails or any of its representatives for any injury, loss, or damage connected with my participation.
Emergency Medical Consent
In the event of an accident or emergency, I authorize Ryder's Riverside Trails to secure medical treatment for myself (or my child/ward) as deemed necessary. I agree to assume full financial responsibility for such treatment.
Severability
If any portion of this agreement is held invalid, the remainder shall continue in full legal force and effect.
Acknowledgment
I HAVE READ AND FULLY UNDERSTAND THIS AGREEMENT. I UNDERSTAND THAT I AM GIVING UP LEGAL RIGHTS BY SIGNING THIS DOCUMENT. I SIGN IT VOLUNTARILY AND OF MY OWN FREE WILL.
RSA 508:19 Notice
You are hereby notified that Ryder's Riverside Trails is not liable for an injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities.
Inherent risks include, but are not limited to: the unpredictable behavior of horses, including bucking, kicking, rearing, biting, or running; collisions with other animals, people, or objects; natural hazards such as rocks, uneven ground, streams, wildlife, or other environmental conditions; tack, equipment, or gear failure; and the potential for riders to act in a negligent manner that may contribute to injury, including failing to maintain control of the horse or not acting within the rider's ability.
By engaging in horseback riding or related equine activities at Ryder's Riverside Trails, you assume all risks of personal injury, death, or property damage.
